Terms & Conditions

In case we are acting as agents our services are subject to the terms and conditions of carrier's Bill of Lading and/or standard conditions for carriage of goods. In all other cases our services are subject to the General Terms and Conditions for Ship Brokers and Ship Agents in Germany, latest edition. In case of freight forwarding services not being subject to Bill of Lading- and/or standard conditons for carriage WE OPERATE EXCLUSIVELY IN ACCORDANCE WITH THE LATEST VERSION OF 'ALLGEMEINE DEUTSCHE SPEDITEURBEDINGUNGEN' - ADSp - (GERMAN FREIGHT FORWARDERS' STANDARD TERMS AND CONDITIONS). THE ADSp LIMIT IN SECTION 23 ADSp THE LEGAL LIABILITY IN ACCORDANCE WITH § 431 OF THE GERMAN COMMERCIAL CODE (HGB) FOR DAMAGE TO GOODS IN THE CASE OF DAMAGE TO GOODS WHILST IN THE CARE OF A FORWARDER TO EUR 5.-- PER KG, IN THE CASE OF MULTIMODAL TRANSPORTS INCLUDING SEA TRANSPORTS TO 2 SPECIAL DRAWING RIGHTS (SDR) PER KG; PLUS IN ADDITION PER DAMAGE OR EVENT TO EUR 1 MILLION OR EUR 2 MILLION RESPECTIVELY OR 2 SDR/KG WHICHEVER IS THE GREATER.PLACE OF JURISDICTION IS, UNLESS WE ARE ACTING AS AGENTS ONLY, HAMBURG, ARBITRATION IS EXCLUDED.

3. No obligation to provide personal data

There is  no general legal or contractual obligation for you to provide us with your personal data; however, we may only be able to provide certain services to a limited extent or not at all if you do not provide the data required for this.

4. Purposes of data processing by the controller and third parties

We process your personal data only for the purposes stated in this privacy policy. We do not transfer your personal data to third parties for purposes other than those mentioned. We will only share your personal data with third parties if:

  • you have given your explicit consent to this,
  • the processing is necessary for the performance of a contract with you,
  • the processing is necessary for compliance with a legal obligation,
  • the processing is necessary to protect legitimate interests and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

5. Collection of general information when visiting our website

When you access our website, some information is automatically collected. This is  information that does not allow any conclusions to be drawn about your person.

  • ensuring the smooth use of our website,

The processing of your personal data is based on our legitimate interest (Article 6(1)(f) GDPR) from the aforementioned data collection purposes. We do not use your data to draw conclusions about your person. Recipients of the data are only the controller and, if applicable, our processors.

The legal basis for this processing is our legitimate interest (Article 6(1)(f) GDPR), namely our legitimate interest in responding to your requests.

Necessary cookies are needed for the core functions of a website. (iii) Marketing Cookies
Marketing cookies are used by advertising companies to display interest-based advertising.  By means of such cookies, information can be shared with social networks and advertising providers. They are also used to display interest-based advertising to you.  This data is also only processed if the user has given their consent within the cookie banner, Article 6(1)(a) GDPR.

We are currently not using any marketing cookies.

8. Applicant management

You can submit you application for positions in our group of companies. The data entered is required for performance the application process. to enable the communication and to process your request. These processing operations are based on Art. 6(1)(b) GDPR. Data of rejected applicants will be deleted after six months.     

9. Duration of data processing

Your data will only be processed for as long as is necessary to achieve the above-mentioned processing purposes; the legal bases stated in the context of the processing purposes apply accordingly.

10. Recipients

We use service providers to process our business transactions (e.g. for the areas of IT, logistics, telecommunications, sales and marketing).

Service providers for the operation of our website and the processing of data stored or transmitted by the systems (e.g. for data center services, payment processing, IT security).

11. Transfer to Third Countries

We do not share personal data with recipients located in third countries, unless this is explicitly stated in this notice. In this case, we ensure to take all required measures to comply with the applicable data GDPR provisions, specifically to enter into the EU -Standard Contractual Clauses.
